FORT LAUDERDALE — A former employee has filed suit against a national grocery chain for allegedly firing him after due to a latex allergic.
Nicholas Vargas filed a complaint Sept. 27 in U.S. District Court for the Southern District of Florida, Fort Lauderdale Division, against Whole Food Market Group Inc., alleging that the employer terminated the plaintiff's employment for exercising his rights to the Family Medical Leave Act.
According to the complaint, the plaintiff alleges that on Sept. 22, 2015, he was terminated from his employment for having a severe medical condition stemming from a latex allergy. The plaintiff holds Whole Food Market Group Inc. responsible because the defendant allegedly failed to provide proper accommodation for the plaintiff's medical condition and ultimately terminated him.
The plaintiff requests a trial by jury and seeks all back wages, all damages and any other relief as the court deems just. He is represented by R. Martin Saenz of Saenz & Anderson PLLC in Aventura.
