Chanel Inc. claims online retailer sells imitation handbags

Trademark 07

MIAMI — An international handbag company has filed suit against another business it claims is selling imitation handbags bearing its trademark.

Chanel Inc. filed a complaint Sept. 27 in U.S. District Court for the Southern District of Florida against the individual, partnership or unincorporated association doing business as imitation-handbags.ru, alleging that they sell counterfeit copies of the plaintiff's products.

According to the complaint, the plaintiff alleges that Chanel Inc. suffered damages from having copies of their products sold online. The plaintiff holds the individual, partnership or unincorporated association doing business as imitation-handbags.ru responsible because the defendant allegedly promotes and sells confusingly similar imitations of the plaintiff's merchandise through its online stores.

The plaintiff seeks an injunction against the defendant, to enjoin the defendant from further infringing the plaintiff's trademarks, pay plaintiff all damages and profits derived from the unlawful act, all legal fees and interest and any other relief as the court deems just. It is represented by Stephen M. Gaffigan, Virgilio Gigante and T. Raquel Rodriguez-Albizu of Stephen M. Gaffigan PA in Ft. Lauderdale.
