Mr. Zhang's Fine Chinese Cuisine employee alleges he is owed unpaid wages

MIAMI – A Palm Beach County man alleges a Palm Beach Gardens restaurant owes him unpaid wages.

Frank Tai Sheng Sheu filed a complaint on Sept. 23 in the U.S. District Court for the Southern District of Florida against Palmer Island LLC, doing business as Mr. Zhang's Fine Chinese Cuisine, and Michael Sumin Zhang citing violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was working as a server/waiter at a restaurant owned by the defendants and Zhang was responsible for determining the wages and salaries of all the servers. The plaintiff alleges that he routinely worked more than 40 hours per week and was not paid overtime and that he made less than minimum wage.

The plaintiff holds Palmer Island LLC and Zhang responsible because the defendants allegedly failed to compensate plaintiff for his hours worked in excess of 40 hours per week, failed to keep accurate records of hours worked by plaintiff and failed to pay plaintiff the minimum wage required by law despite allowance for tip credit.

The plaintiff requests a trial by jury and seeks judgment against the defendant, unpaid wages, costs and attorney’s fees. He is represented by Don R. Boswell of Akers & Boswell PA in West Palm Beach.
