MIAMI – A Santa Monica, California photography studio alleges a Coral Gables company used its celebrity photographs on a website without permission.
Michael Grecco Productions Inc. filed a complaint on Sept. 23 in the U.S. District Court for the Southern District of Florida against Terra Networks Operations Inc. alleging copyright infringement.
According to the complaint, the plaintiff alleges that it discovered that defendant was infringing its exclusive copyrighted works by reproducing, distributing, and/or publicly displaying the works on the defendant's websites. The infringing photographs, which the plaintiff alleges caused it irreparable injury, allegedly featured popular Hollywood stars such as Quentin Tarantino, Ben Stiller and Owen Wilson.
The plaintiff holds Terra Networks Operations Inc. responsible because the defendant allegedly profited at the expense of plaintiff, violated plaintiff’s exclusive rights and failed to remove all infringing photographs to date despite acknowledgment of demand letter from plaintiff.
The plaintiff requests a trial by jury and seeks judgment against defendant, accounting of defendant's revenues, costs, disbursements, attorneys’ fees, interest and further relief as the court may deem just. It is represented by Karen C. Kline of Duane Morris LLP in Boca Raton and Steven M. Cowley of Duane Morris LLP in Boston, Massachusetts.
