Employee claims La Flor De Espana Bakery and Restaurant owes back wages

TAMPA – A Polk County man alleges a Winter Haven restaurant has not properly compensated him for all hours worked in his position as an assistant manager.

Juan Rodriguez filed a complaint on Sept. 26 in the Tampa Division for the Middle District of Florida against Velsan Inc., doing business as La Flor De Espana Bakery and Restaurant, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for more than 40 hours per week without being paid any overtime compensation. The plaintiff holds Velsan Inc. responsible because the defendant allegedly failed to pay plaintiff any overtime premium for hours worked in excess of 40 hours.

The plaintiff requests a trial by jury and seeks unpaid back wages, liquidated damages, interest, all legal fees and any other relief as the court deems just. He is represented by Luis A. Cabassa of Wenzel Fenton Cabassa PA in Tampa.
