Man alleges Capital One Bank (USA) NA has called more than 100 times

ORLANDO – An Orange County consumer claims a Virginia corporation continued to call him in an attempt to collect an alleged debt after he revoked his consent.

Alan Eubanks filed a complaint on Sept. 26 in the U.S. District Court for the Middle District of Florida, Orlando Division against Capital One Bank (USA) NA alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that since April, the defendant has called him 125 times in an attempt to collect an alleged debt. The plaintiff holds Capital One Bank (USA) NA responsible because the defendant allegedly used an automatic telephone dialing system to contact plaintiff and continued to call after he revoked his consent.

The plaintiff requests a trial by jury and seeks statutory damages, punitive damages, actual damages, all legal fees plus interest and any other relief as the court deems just. He is represented by Amy Ferrera of Morgan & Morgan, Tampa PA in Tampa.
