Man accuses Navient Solutions Inc., Student Assistance Corp. of harassment

TAMPA – A consumer alleges two debt collectors harassed him with more than 400 calls.

Michael Perez filed a complaint on Sept. 23 in the Tampa Division for the Middle District of Florida against Navient Solutions Inc. and Student Assistance Corp. citing the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that beginning June 2013, he was called numerous times on his cellular telephone in an attempt to collect a student loan. He alleges the defendants were using an automatic telephone dialing system or a pre-recorded or artificial voice and as a result of defendants' acts, plaintiff was affected by stress, anxiety, nervousness, embarrassment, distress and aggravation.

The plaintiff holds Navient Solutions Inc. and Student Assistance Corp. responsible because the defendants allegedly called with such frequency meant to harass and abuse and refused to cease calls to plaintiff despite repeated demands to cease calls.

The plaintiff requests a trial by jury and seeks judgment against defendants; for statutory, punitive, and actual damages; costs; interest; attorney's fees; enjoinder from further violations of these parts; and other relief the court may deem just.
