Case manager alleges American Eldercare Inc. did not properly pay for all hours worked

FORT LAUDERDALE – A long-term care case manager claims she was not paid overtime.

Marlen Martinez filed a complaint on Sept. 26 in the U.S. District Court for the Southern District of Florida against American Eldercare Inc. citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she worked for more than 40 hours without being paid any overtime compensation. The plaintiff holds American Eldercare Inc. responsible because the defendant allegedly failed to pay a rate of time-and one-half to plaintiff for hours worked that exceeded 40 per week.

The plaintiff requests a trial by jury and seeks judgment against the defendant for overtime damages, liquidated damages, all legal fees and any other relief as the court deems just. She is represented by Noah E. Storch and Richard Celler of Richard Celler Legal PA in Davie.
