MIAMI – The owner of a Miami Beach property alleges its tenant failed to complete agreed upon work and pay rent.
Palm Court at 23rd Street LTD filed a complaint on Sept. 22 in the U.S. District Court for the Southern District of Florida, Miami Division against 2901 JMH LLC and Jason Halpern alleging breach of contract.
According to the complaint, the plaintiff alleges that on Nov. 2, 2015, it entered into a two-year written lease with the defendants, to which plaintiff agreed to lease improved portions of its property located at Miami Beach. In return, the suit states the defendants were to pay rent and complete certain tenant improvements and deliver property back to plaintiff in operational and vacant condition. The suit states that when the defendants' plans changed, they left the premises in an unusable, demolished state, replete with construction debris and without completing its required improvements.
The plaintiff holds 2901 JMH LLC and Halpern responsible because the defendants allegedly failed to timely and fully pay rent due for the month of May and every month thereafter and failed to complete the tenant’s work and/or pay the costs to complete the improvements.
The plaintiff requests a trial by jury and seeks judgment in favor of plaintiff, damages, plus interest, costs, and attorney's fees, and any further relief as the court deems just. It is represented by Christopher F. Zacarias of Law Offices of Christopher F. Zacarias PA in Miami.
