Annellie's Car Wash accused of terminating man in retaliation for wage complaints

Wrongful term 14

FORT LAUDERDALE – A former employee of a Broward County car wash alleges he was terminated in retaliation for complaining about not receiving a minimum wage or overtime pay.

Donte A. Faine filed a complaint on behalf of other similarly situated individuals on Sept. 22 in the U.S. District Court for the Southern District of Florida, Fort Lauderdale Division against Annellie's Car Wash LLC and Rene L. Moreno citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between Jan. 15 and August, he worked for 77 hours per week for the defendants without being paid any overtime compensation or a regular rate of pay. He alleges he was terminated shortly after complaining to Moreno about not receiving a minimum wage or overtime pay. The plaintiff holds Annellie's Car Wash LLC and Moreno responsible because the defendants allegedly failed to pay plaintiff any overtime premium for hours worked that exceeds 40 hours at a rate of time-and-one-half and did not keep accurate time records.

The plaintiff requests a trial by jury and seeks compensatory damages, liquidated damages, back pay and any other benefits wrongly denied, all legal fees and interest, plus any other relief as this court deems just. He is represented by Zandro E. Palma of Zandro E. Palma PA in Miami.
