JACKSONVILLE – A Putnum County woman alleges a debt collector continued to call her for a debt she does not owe.
Christina Belcher filed a complaint on Sept. 19 in the U.S. District Court for the Middle District of Florida, Jacksonville Division against Medicredit Inc. alleging violation of the Florida Consumer Collection Practices Act, the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in June, she started receiving calls from defendant said to be collecting an alleged debt. Plaintiff denied of such debt and verbally demanded and also sent a facsimile transmission to defendant's number to cease calling her cellular telephone and to contact plaintiff's attorney instead, the suit states. She alleges the defendant continued to make numerous calls to her using an automatic telephone dialing system or an artificial or prerecorded voice.
The plaintiff holds Medicredit Inc. responsible because the defendant allegedly caused to harass and abuse plaintiff with its incessant calls and utilized an auto-dialer and an artificial or prerecorded voice and continued to make numerous calls despite being told not to.
The plaintiff requests a trial by jury and seeks judgment against defendant, damages, injunctive relief, costs of action, attorney's fees and other relief the court deems just. She is represented by Christopher W. Boss of Boss Law in St. Petersburg.
