Consumer alleges Medical & Financial Management Inc. letter violates debt collection laws

MIAMI – A Stuart debt collector is facing allegations from a St. Lucie County woman that it mailed a misleading collection letter and has filed a class-action suit.

Rosa G. Cala filed a complaint on behalf of all others similarly situated on Sept. 22 in the U.S. District Court for the Southern District of Florida against Medical & Financial Management Inc. citing the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff received a collection letter from the defendant for an alleged medical debt in June. The plaintiff holds Medical & Financial Management Inc. responsible because the defendant allegedly used the name MFMI Collection Service in the letter and that is not an existing business entity, the defendant did not obtain a debt collection license to collect a debt and other violations of the FDCPA.

The plaintiff seeks statutory damages, all legal fees and interest and any other relief as the court deems just. She is represented by Leo W. Desmond of Desmond Law Firm PC in Vero Beach.
