MIAMI – A kitchen worker alleges she was terminated by her Miami-County employer in retaliation for complaining about not being paid overtime.
Estela Milo filed a complaint on behalf of other similarly situated individuals on Sept. 22 in the U.S. District Court for the Southern District of Florida Miami Division against Cacao Express Inc. and Elda Benshimol citing the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that between 2015 and 2016, she worked for more than 40 hours without being paid any overtime compensation. She alleges she was terminated in August in retaliation for complaining about not being paid for the overtime hours. The plaintiff holds Cacao Express Inc. and Benshimol responsible because the defendants allegedly failed to pay overtime premiums at a rate of time-and-one-half and did not keep accurate time records.
The plaintiff requests a trial by jury and seeks compensatory damages, liquidated damages, all legal fees and any other relief as the court deems just. She is represented by Zandro E. Palma in Miami.
