Ally employee seeks reinstatement to Hartford Life disability benefits

MIAMI – An Ally Financial employee alleges an insurance firm wrongfully terminated her disability benefits.

Jodi A. Santomarco-Bonanno filed a complaint on Sept. 20 in the U.S. District Court for the Southern District of Florida against Hartford Life and Accident Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in Nov. 6, 2012, she became disabled and was initially being paid disability benefits until its termination on May 8, 2015. The plaintiff holds Hartford Life and Accident Insurance Co. responsible because the defendant allegedly upheld its decision to deny disability benefits to plaintiff despite still being disabled according to the terms of the plan.

The plaintiff seeks payment of disability benefits due, reinstatement to the plan, all legal fees and interest, and any other relief as the court deems just. She is represented by Victor Peña and Gregory Michael Dell of Attorneys Dell and Schaefer Chartered in Hollywood.
