Former employee alleges Wireless One misclassified him as an independent contractor

MIAMI – A salesperson for a Miami-Dade County wireless retailer alleges he was misclassified as an independent contractor and is owed unpaid overtime wages.

Lazaro D. Echevarria filed a complaint on Sept. 16 in the U.S. District Court for the Southern District of Florida against Wireless One LLC and Ali A. Ali citing the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he worked for 60 to 65 hours per week without being paid any overtime compensation from March 2015 to March of this year. The plaintiff holds Wireless One LLC and Ali responsible because the defendants allegedly failed to pay overtime wages at a rate of time-and-one-half of his regular rate of pay and misclassified him as an independent contractor.

The plaintiff requests a trial by jury and seeks to recover the greater of $5,000 for each fraudulent tax information return filed by defendant for each year, all legal fees and interest plus any other relief as the court deems just. He is represented by Brian H. Pollock of Fairlaw Firm in Miami.
