Enhanced Recovery Company allegedly violated debt collection law

FORT LAUDERDALE — A consumer has filed suit against a debt collector for allegedly violating the law by engaging in deceptive, misleading and unfair debt collection practices.

Clara Archibald filed a complaint Sept. 14 in U.S. District Court for the Southern District of Florida against Enhanced Recovery Company LLC.

According to the complaint, the plaintiff alleges that on March 15, she disputed the alleged debt directly with the defendant with a written letter, but upon checking her credit report again on May 4, she discovered that the defendant had not removed the credit account nor marked it as ''disputed by consumer'' despite being required to do so by law, which caused the plaintiff to suffer damages. The plaintiff holds Enhanced Recovery Company LLC responsible because the defendant allegedly failed to remove the credit account nor mark it as ''disputed by consumer."

The plaintiff requests a trial by jury and seeks judgment from the defendant, actual and statutory damages, attorney's fees, costs, and further relief, as well as further costs, expenses and disbursements of the action as the court may deem just.
