Consumer alleges Citibank called roughly 300 more times after she revoked consent

GAINESVILLE – An Alachua County alleges a debt collector called her hundreds of times after she requested it quit contacting her by phone.

Julia E. Cole filed a complaint on Sept. 16 in the U.S. District Court for the Northern District of Florida against Citibank NA citing the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that in December 2015, she started receiving calls from the defendant on her cellular telephone in an attempt to collect an alleged debt. She claims that that despite revoking her consent to call her in January, she has received approximately 300 times since then.

The plaintiff holds Citibank NA responsible because the defendant allegedly placed calls using an automatic telephone dialing system or an artificial or prerecorded voice and caused plaintiff to be harassed and abused from the continuous, unsolicited calls.

The plaintiff requests a trial by jury and seeks judgment against defendant for damages, costs, interest, attorney's fees, enjoinder from further violations of these parts and other relief the court may deem just. She is represented by Frank H. Kerney of Morgan & Morgan PA in Tampa.
