Security guards claim Dalama Protection failed to pay overtime wages

FORT LAUDERDALE — A security guard has filed a class-action lawsuit against his previous employer for allegedly failing to pay him overtime wages.

Ramond Haughton filed a complaint on behalf of himself and others similarly situated Sept. 15 in U.S. District Court for the Southern District of Florida, Fort Lauderdale Division, against Dalama Protection LLC and Osvaldo Dalama, alleging that they violated the Fair Labor Standards Act (FLSA) through unlawful compensation.

According to the complaint, the plaintiffs allege that from May 21, 2013, through July 13, 2016, Ramond Haughton, named plaintiff, and the class similarly situated to him, worked for the defendants as security guards. They claim to have regularly worked in excess of 40 hours per week, but were only paid their regular hourly rate for overtime hours, not at the rate of one and one-half times their regular salary as mandated by law. 

The plaintiffs hold Dalama Protection LLC and Osvaldo Dalama responsible because the defendants allegedly failed to maintain proper time records, failed to properly disclose or apprise plaintiffs of their rights and failed to adequately compensate overtime work at a rate of one and one-half times of regular pay.

The plaintiffs request a trial by jury and seek judgment in their favor, be certified as a class suit, permit notice to potential class members, a declaration of FLSA violation, damages, costs, expenses, attorneys' fees and other relief as deemed appropriate.
