Veteran seeks order for benefits to provide surgery

JACKSONVILLE – A Jacksonville veteran is seeking an order declaring that his veteran's benefits qualify him for a surgery.

Franklin Gill filed a suit against the Malcom Randall VA Medical Center and the Jacksonville Outpatient Clinic on Sept. 12 in the U.S. District Court for the Middle District of Florida, Jacksonville Division alleging medical malpractice, medical neglect and discrimination.

 

The suit states that in November 2014, Gill was diagnosed with gynescomastia by Dr. Ana Marisol Conde-Rose and the diagnosis was confirmed on Feb. 13, 2015, by Subbarayan K. Sreevidya. On July 7, 2015, McGuire allegedly told Gill that surgery would be needed, but the surgery was never inputted into the Veterans Administration system. He alleges false statements made to the Choice Program prevented him from getting the surgery he needed.

The plaintiff is seeking an order that the VA is obligated to do the surgery as his benefits entitle; compensation for distress, mental, and emotional anguish; and an order of compensation for discrimination by the VA staff. He is representing himself.
