Woman alleges Santander Consumer USA Inc. harassed her with hundreds of calls

TAMPA – A Port Richey consumer is suing a debt collector over allegations it intentionally harassed and abused her with more than 300 calls.

Alison Moran filed a complaint on Sept. 9 in the Tampa Division for the Middle District of Florida against Santander Consumer USA Inc. citing the Telephone Consumer Protection Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that she received a barrage of daily calls from the defendant in an attempt to collect an alleged auto loan debt. She alleges she requested and revoked any prior express consent for the defendant to call her in July 2014, but defendant continued to call persistently.

The plaintiff holds Santander Consumer USA Inc. responsible because the defendant allegedly caused plaintiff to feel harassed and abused, caused placement of non-emergency telephone calls to plaintiff’s cellular telephone without prior express consent and obtained financial benefits from using an automatic dialing system or a prerecorded or artificial voice message to collect debts.

The plaintiff requests a trial by jury and seeks judgment against defendant for statutory, punitive, and actual damages, costs, interest, attorneys' fees and any other such relief the court may deem just and proper.
