Laborer claims he was required to work off the clock without pay for Noble Resources Corp.

TAMPA – A laborer has filed a class-action lawsuit against a Hillsborough County employer alleging he worked an additional six to 10 hours a week without being paid for it.

Pedro Contreras filed a complaint on behalf of himself and others similarly situated on Sept. 2 in the Tampa Division for the Middle District of Florida against Noble Resources Corp. alleging violation of the Fair Labor Standards Act.

According to the complaint, from January 2011 to March, Contreras was employed by defendant as a laborer with non-exempt job duties and routinely worked at least 6 to 10 hours of overtime per week for which he was not compensated. As a result of said conduct, the plaintiff alleges was forced to retain counsel and incurred attorney's fees and litigation costs. 

The plaintiff holds Noble Resources Corp. responsible because the defendant allegedly failed to pay employees for overtime hours worked, failed to post required FLSA informational listings and failed to maintain and keep accurate time records.

The plaintiff requests a trial by jury and seeks judgment against defendant for the payment of all overtime hours, liquidated damages, attorneys’ fees and costs of action and further relief that the court deems to be just. He is represented by Marc R. Edelman of Morgan & Morgan PA in Tampa.
