Consumer alleges Bass & Associates tried to collect more than $3,000 in fees

Late 06

MIAMI – A Broward County man alleges a debt collector tried to collect fees it is not authorized to collect.

Patrick Gentles filed a complaint on Sept. 6 in the U.S. District Court for the Southern District of Florida against Bass & Associates PC citing the Fair Debt Collection Practices Act and the Florida Consumer Collection Practices Act.

According to the complaint, the plaintiff alleges that on Aug. 18, he received a collection letter from the defendant regarding a student loan allegedly in default. The letter stated that the plaintiff owed $3,671.26 for fees and costs, the suit states. The plaintiff holds Bass & Associates responsible because he alleges the defendant does not have the contractual authority to collect the fees.

The plaintiff requests a trial by jury and seeks statutory and actual damages, injunction against the defendant, all legal fees and any other relief as the court deems just. He is represented by Jibrael S. Hindi of The Law Offices of Jibrael S. Hindi in Fort Lauderdale and Thomas J. Patti of Thomas-John Law PA in Fort Lauderdale.
