Woman alleges she was damaged because insurer did not provide coverage after accident

SANFORD – A Seminole County woman alleges her insurance company has denied her underinsured motorist coverage to compensate her for injuries in a crash.

Rebecca Berg filed a complaint on Sept. 1 in the 18th Judicial Circuit Court in Seminole County against Garrison Property and Casualty Insurance Co. citing statutory bad faith and other counts.

According to the complaint, the plaintiff alleges that on March 30, 2014, she was involved in a motor vehicle crash, which was caused solely by the negligence of an underinsured driver, and was injured. At the time of the crash, the suit states the plaintiff was covered by an auto insurance policy from defendant, which provided her with uninsured/underinsured motorist coverage. She alleges the other driver's insurance coverage was not sufficient to compensate the plaintiff and she reported a claim to the defendant for underinsured motorist coverage, except defendant allegedly refused to honor its contractual obligations. 

The plaintiff holds Garrison Property and Casualty Insurance Co. responsible because the defendant allegedly denied plaintiff's uninsured motorist claim without conducting a reasonable investigation, failed to provide a reasonable explanation on basis of denial of coverage and placed its own financial interests before that of plaintiff.

The plaintiff requests a trial by jury and seeks judgment against defendant, damages, pre- and post-judgment interest, attorney's fees, costs and any other relief the court deems proper. She is represented by Joshua A. Andone of Hale, Hale & Jacobson PA in Orlando.
