MIAMI – A Miami-Dade County woman alleges a North Carolina-based debt collector called her in an attempt to collect a debt from another person.
Chanell S. Ward filed a complaint on Aug. 31 in the U.S. District Court for the Southern District of Florida against Jon Barry and Associates Inc., doing business as Paragon Revenue Group, citing the Telephone Consumer Protection Act and the Fair Debt Collection Practices Act.
According to the complaint, the plaintiff alleges that she suffered damages from receiving several collection calls that were intended for another alleged debtor. The plaintiff holds Jon Barry and Associates Inc., doing business as Paragon Revenue Group, responsible because the defendant allegedly used an automatic telephone dialing system in contacting plaintiff and failed to determine the identity of the number of it was calling before placing the automated calls.
The plaintiff requests a trial by jury and seeks damages, permanent injunction against the defendant, all legal fees and any other relief as the court deems just. She is represented by Donald A. Yarbrough in Fort Lauderdale.
