Woman alleges Bank of America, Aetna Life wrongfully denied disability benefits

MIAMI – A Bank of America employee alleges she was wrongfully denied short and long-term disability benefits.

Ann Marie Dee filed a complaint on Aug. 31 in the U.S. District Court for the Southern District of Florida against Bank of America Corp. and Aetna Life Insurance Co. citing the Employee Retirement Income Security Act.

According to the complaint, the plaintiff alleges that in July 2015, she became disabled and was initially being paid disability benefits until it was terminated effective Dec. 15, 2015. The plaintiff holds Bank of America Corp. and Aetna Life Insurance Co. responsible because the defendants allegedly upheld their decision to deny further disability benefits to plaintiff despite her purportedly still being disabled according to the terms of the plan.

The plaintiff seeks payment of short and long-term disability benefits, reinstatement, order the defendant that plaintiff is entitled to disability benefits for as long as she remains disabled, all legal fees and interest plus any other relief as the court deems just. She is represented by Alexandra A. Palamara and Gregory Michael Dell of Attorneys Dell and Schaefer Chartered in Hollywood.
