Cigna Group Insurance allegedly failed to pay woman long-term disability payments

FORT MYERS — A woman has filed suit against an insurance company for allegedly stopping her long-term disability payments.

Lorreta Johnson filed a complaint on July 22 in U.S. District Court for the Middle District of Florida, Fort Myers Division, against Cigna Group Insurance, alleging that the plan administrator violated the plaintiff's rights to receive benefits.

According to the complaint, the plaintiff alleges that on Sept. 11, 2015, she was denied further claims to receive benefits from her long-term disability plan, although the plaintiff purportedly continued to meet the definition of disability due to vertigo, complex regional pain syndrome and migraines, which were also fully supported by her treating physicians. The plaintiff holds Cigna Group Insurance responsible because the defendant allegedly failed to uphold the rights of the plaintiff to receive long-term disability benefits, refused to pay sums due to the plaintiff and failed to act on good faith without being biased.

The plaintiff requests a trial by jury and seeks an order declaring her right to benefits, damages, relief, attorney's fees and costs of litigation. She is represented by Nancy L. Cavey of Law Offices of Nancy L. Cavey in St. Petersburg.
