Man claims Quest Diagnostics terminated him while on FMLA leave

OCALA – A man alleges his Marion County employer unlawfully terminated in him retaliation for taking a medical leave.

Kevin Cauley filed a complaint on Aug. 31 in the U.S. District Court for the Middle District of Florida, Ocala Division against Quest Diagnostics Inc. citing the Family and Medical Leave Act.

According to the complaint, the plaintiff alleges that in November 2015 he applied for FMLA leave because of complications from congestive heart failure and the leave was granted. He later applied for an extension of the leave in January, the suit states, but was accused of abandoning his position and was ultimately terminated.

The plaintiff holds Quest Diagnostics Inc. responsible because the defendant allegedly terminated plaintiff's employment as retaliation for exercising his right to FMLA.

The plaintiff requests a trial by jury and seeks back pay, liquidated damages in an equal amount, other monetary damages, all legal fees and any other relief as the court deems just. He is represented by Noah E. Storch and Richard Celler of Richard Celler Legal PA in Davie.
