Truck driver alleges he was not paid for miles traveled, overtime worked

MIAMI – A Lake Worth resident alleges an Illinois corporation doing business in the state did not adequately compensate him for all hours worked.

Joselito R. Gabon filed a complaint on Aug. 30 in the U.S. District Court for the Southern District of Florida against Kairos Logistics Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was employed as truck driver and was to be paid 45 cents per mile traveled. He alleges in January, he drove more than 2,000 miles and was not compensated by the defendant and was not paid for a two-day layover. The plaintiff holds Kairos Logistics Inc. responsible because the defendant allegedly also failed to pay overtime premium to plaintiff for hours worked that exceeded 40 per week.

The plaintiff requests a trial by jury and seeks back pay, unpaid wages, liquidated damages, reimbursement of expenses, all legal fees and interest plus any other relief as the court deems just. He is represented by Neil Tygar of Neil Bryan Tygar PA in Delray Beach.
