Best of Golf America allegedly infringed upon golf divot repair tool patent

WEST PALM BEACH — A manufacturer of divot repair tools has filed suit against a competitor for alleged patent infringement.

Sandgroup International LTD filed a complaint on Aug. 25 in U.S. District Court for the Southern District of Florida against Best of Golf America LLC, alleging that the Florida corporation intentionally violated patent law by manufacturing infringing products.

According to the complaint, the plaintiff alleges that it has suffered irreparable harm to its reputation and business, which is purportedly known for excellence and innovation, as a result of the defendant reportedly infringing upon the plaintiff's patented golf divot repair tools. 

The plaintiff holds Best of Golf America LLC responsible because the defendant allegedly argued that the plaintiff has no patent protection and that the designs are free to copy, obtained profits from infringement of the plaintiff's patented designs and offered imitation products to others for resale.

The plaintiff requests a trial by jury and seeks judgment against the defendant, damages, interest, attorney's fees and other relief as the court deem just. It is represented by Louis R. Gigliotti of Louis R. Gigliotti PA in Hollywood.
