Home health aide alleges Absolute Health Professionals misclassified her

ORLANDO – A home health aide alleges she was misclassified as an independent contractor and was not properly compensated by her former employer's Port Orange location.

Pamlian Jefferson filed a complaint on Aug. 29 in the U.S. District Court for the Middle District of Florida, Orlando Division against Absolute Health Professionals Inc., Suzanne M. Anderson and Jennifer M. Anderson alleging violation of the Fair Labor Standards Act and the Florida Deceptive Trade Practices Act.

According to the complaint, the plaintiff alleges that between November 2014 and March, she was not paid any overtime compensation or paid at a rate equal to minimum wage. The plaintiff holds Absolute Health Professionals Inc., Suzanne M. Anderson and Jennifer M. Anderson responsible because the defendants allegedly failed to pay any overtime premium to plaintiff for hours worked that exceeds 40 and failed to maintain accurate time records.

The plaintiff requests a trial by jury and seeks actual damages, all legal fees and any other relief as the court deems just. She is represented by Scott C. Adams and N. Ryan Labar of Labar & Adams PA in Orlando.
