Woman alleges Steak N Shake owes unpaid wages

OSCEOLA – A Kissimmee woman alleges she was not paid proper wages while working as a server for a restaurant.

Brandi DiBlasi-Rouselle filed a complaint on Aug. 29 in the Osceola County Circuit Court against Steak N Shake Operations Inc., doing business as Steak N Shake #285, alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between August 2013 and February 2014, she worked for more than 40 hours a week without being paid any overtime wages. The suit states that the defendant also improperly applied a tip credit for when the plaintiff was performing non-tipped work.

The plaintiff requests a trial by jury and seeks liquidated damages, all unpaid wages, interest, all monies contributed to the improper tip pool, unpaid overtime wages, all legal fees and any other relief as the court deems just.
