Shopper slips and falls in Sam's Club, alleges negligence

SARASOTA — A consumer has filed suit against a retailer after she allegedly slipped in a puddle of liquid in the store and fell.

Anna Maria Madaras filed a complaint on Aug. 17 in the Twelfth Judicial Circuit Court for Sarasota County against Sam's East Inc., doing business as Sam's Club, citing alleged breach of duty, failure to warn, insufficient measures taken to prevent injuries and negligence.

According to the complaint, the plaintiff alleges that on Nov. 18, 2012, she sustained substantial injury when she slipped and fell on a puddle within the vicinity of the defendant's property, causing her to reportedly suffer from a physical disability, mental anguish and incurred medical expenses. 

The plaintiff holds Sam's East Inc. responsible because the defendant allegedly failed to warn the plaintiff of the dangerous condition and failed to maintain safe premises.

The plaintiff requests a trial by jury and seeks judgment against the defendant, damages in excess of $15,000 and other relief she may be entitled to. She is represented by Brian K. Sebaaly of Lancaster & Eure PA in Sarasota.
