Abercrombie & Fitch Trading Co. claims online store sells counterfeit products

MIAMI  – An Ohio-based retail clothing store alleges counterfeit versions of its products are being sold online.

Abercrombie & Fitch Trading Co. filed a complaint on Aug. 26 in the U.S. District Court for the Southern District of Florida against Aliyer, Amy shen, bestpop store, et al. alleging trademark infringement and other counts.

According to the complaint, the plaintiff alleges that it suffered damages to its business. The plaintiff holds the defendants responsible because the defendants allegedly sell counterfeit goods bearing plaintiff's trademark online at AliExpress.com, which the plaintiff claims causes confusion among its customers.

The plaintiff seeks enjoin the defendant from further infringing plaintiff's trademark, pay plaintiff all profits and damages derived from the unlawful act, all legal fees and any other relief as thec ourt deems just. It is represented by Stephen M. Gaffigan, Virgilio Gigante and T. Raquel Rodriguez-Albizu of Stephen M. Gaffigan PA in Fort Lauderdale.
