Man files class-action suit seeking alleged unpaid overtime wages

MIAMI — A former employee has filed a class-action lawsuit against several businesses for alleged unpaid overtime wages.

Samraj Baliram filed a complaint on behalf of himself and others similarly situated on July 24 in U.S. District Court for the Southern District of Florida against Rexall Sundown Inc., NBTY Inc. and other entities 1-10, alleging that they violated the rights of plaintiffs under the Fair Labor Standards Act (FLSA).

According to the complaint, the plaintiff alleges that he and others similarly situated suffered damages by being classified by the defendants as exempt employees from overtime wages, but worked as non-exempt completing packaging, machine maintenance and clerical work. The plaintiff claim he and others similarly situated were entitled to overtime wages. 

The plaintiffs hold Rexall Sundown Inc., NBTY Inc. and other entities 1-10 responsible because the defendants allegedly failed to properly compensate the plaintiffs, instead declaring them to be exempt employees and avoid having to pay overtime compensation as required by the FLSA.

The plaintiff and others request a trial by jury and seeks to recover unpaid overtime compensation, liquidated damages, costs of suit and attorneys’ fees. They are represented by Keith M. Stern and Hazel Solis Rojas of Law Office of Keith M. Stern PA in Doral.
