Former employees claim HB Marble & Granite LLC allegedly didn't pay overtime

FORT MYERS — A group of workers has filed a class-action lawsuit against their former employer who allegedly did not pay them overtime.

Wilber Ramirez filed a complaint on behalf of himself and others similarly situated on Aug. 16 in U.S. District Court for the Middle District of Florida, Fort Myers Division, against HB Marble & Granite LLC and Valdinei Desouza, alleging that they violated the rights of the plaintiffs under the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that from March 2014 until January 2016, plaintiff Ramirez and others similarly situated worked for the defendants as laborers on an hourly basis, routinely in excess of 40 hours per week. 

The plaintiffs hold HB Marble & Granite LLC and Valdinei Desouza responsible because the defendants allegedly failed to compensate the plaintiffs for overtime worked and failed to maintain proper time records.

The plaintiffs request a trial by jury and seek overtime compensation, liquidated damages, attorney's fees, costs of suit, interest and other relief as the court deems appropriate. They are represented by Paul M. Botros of Morgan & Morgan PA in Plantation.
