MIAMI – A landscaper has filed a class-action lawsuit against his former employer over allegations he was not paid overtime wages.
Anites Georges filed a complaint on his own behalf and others similarly situated on Aug. 19 in the U.S. District Court for the Southern District of Florida against M.D.L. Property Maintenance Inc., doing business as Palm Beach-Broward Landscaping, and Robert Monti alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff alleges that from June 2011 until May, he was employed as a driver, landscape maintenance personnel and land designer for defendants’ residential and commercial clients. He alleges he routinely worked more than 40 hours per week but the defendants would only selectively pay him for certain overtime hours worked.
The plaintiffs hold M.D.L. Property Maintenance Inc. and Robert Monti responsible because the defendants allegedly failed to compensate plaintiff for all overtime hours worked, failed to monitor employees' work hours and failed to calculate and pay overtime wages accurately.
The plaintiff request a trial by jury and seeks for payment of all overtime hours, damages, interest, attorney's fees, costs of suit and other relief that the court deems just. He is represented by Maguene D. Cadet of Law Office of Dieudonne Cadet PA in Boynton Beach.
