Cabinet installer claims Cabinet Warehouse Plus allegedly didn't pay him overtime

TAMPA — A man has filed a claim against his former employer, alleging he wasn't paid overtime.

Matthew Collins filed a complaint on Aug. 18 in the Tampa Division of the Middle District of Florida against Cabinet Warehouse Plus Inc. and Joe Braccio, alleging that they violated his rights as plaintiff under the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that from March 1 to July 29, he was employed by the defendants as a cabinet installer and claims he worked an average of 50 hours per week throughout his employment, but allegedly was not fully compensated for the extra hours he worked in a span of 22 weeks, which amounts to $8,580.

The plaintiff holds Cabinet Warehouse Plus Inc. and Joe Braccio responsible because the defendants allegedly failed to pay the full amount of overtime compensation and failed to uphold the rights of non-exempt employees to receive overtime premiums.

The plaintiff requests a trial by jury and seeks judgment against defendants, overtime compensation, damages and liquidated damages, attorney's fees, costs of suit and other relief that the court may deem just. He is represented by James M. Loren of Goldberg & Loren PA in Plantation.
