Former employee claims NCR Corp. allegedly failed to pay overtime wages

TAMPA — A former employee has filed a class-action lawsuit against his employer for alleged unpaid overtime.

David Warner filed a complaint on behalf of himself and those similarly situated on Aug. 19 in the Tampa Division of the Middle District of Florida against NCR Corp., alleging that the business failed to fairly compensate the plaintiff for all of the hours he worked.

According to the complaint, the plaintiff alleges that between July 2007 and June 2015, he worked for more than 40 hours weekly without being paid any overtime wages. The plaintiff holds NCR Corp. responsible because the defendant allegedly misclassified the plaintiff in order to avoid paying him any overtime premium for hours worked that exceeds 40 hours.

The plaintiff requests a trial by jury and seeks overtime compensation due to him, liquidated damages, all legal fees and any other relief as the court deems appropriate. He is represented by C. Ryan Morgan of Morgan & Morgan P.A. in Orlando.
