Virginia corporation allegedly used stolen information from competitors

MIAMI — Two businesses have filed suit against a Virginia corporation who allegedly hired a former employee who purportedly swiped confidential information from his previous employers. 

Unifire Inc. and Source One Distributors Inc. filed a complaint on Aug. 9 in U.S. District Court for the Southern District of Florida against Atlantic Diving Supply Inc, doing business as ADS Inc., alleging that the Virginia corporation aided in the breach of the fiduciary duty of loyalty and conversion.

According to the complaint, the plaintiffs allege that on December 2015, Unifire Inc. and Source One Distributors Inc. entered into an agreement where Unifire purchased the assets of Source One. One of the company's former employees, Christopher Vilter, allegedly pilfered confidential information, then Vilter and the defendant purportedly used the plaintiffs' confidential information to the extreme detriment of the plaintiffs' business. The plaintiffs hold Atlantic Diving Supply Inc. responsible because the defendant allegedly engaged and continues to engage in deceptive and fraudulent conduct and created consumer confusion.

The plaintiffs request a trial by jury and seek a permanent injunction against the defendant, mandating the return of all confidential and proprietary information, enjoining the defendant and all others from making further use of that information, damages, interest, costs and all further relief that the court deems just. They are represented by Paul O. Lopez, John M. Mullin and Ryan H. Lehrer of Trip Scott PA in Fort Lauderdale.
