Employee claims Dollar Tree allegedly did not pay him for earned overtime

SANFORD — An employee has filed suit against a discount store for allegedly not paying the plaintiff for overtime hours.

Jesse Hinkle filed a complaint on Aug. 15 in the 18th Judicial Circuit in Seminole County against Dollar Tree Stores Inc., citing alleged breach of contract, unpaid wages, and violation of workers compensation acts.

According to the complaint, the plaintiff alleges that, between January 2010 and the present time, he was not paid the correct wage based upon their agreement including not being paid for overtime wages. The plaintiff holds Dollar Tree Stores Inc. responsible because the defendant allegedly removed portions of the plaintiff's check without his consent to avoid paying him the correct rate based on their agreement.

The plaintiff requests a trial by jury and seeks liquidated damages, damages for all unpaid wages, all monies withheld, all legal fees and interest and any other relief as the court deems appropriate. He is represented by Michael L. Grossman of Cohen Grossman, Attorneys at Law in Maitland.
