MIAMI — An individual is suing Montgomery Ward Inc., Seventh Avenue Inc. and Ginny's Inc., citing alleged violation of telephone harassment statutes after more than 150 calls were placed to her cellphone.
Carole Schwimmer filed a complaint on Aug. 9 in the U.S. District Court for the Southern District of Florida against the Wisconsin-based defendants, alleging violation of the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in 2013 she was contacted on her cellphone several times. The plaintiff holds Montgomery Ward Inc., Seventh Avenue Inc. and Ginny's Inc. responsible, because the defendants allegedly used an automatic telephone dialing system to contact the plaintiff.
The plaintiff requests a trial by jury and seeks damages, permanent injunction against the defendant and any other relief as the court deems reasonable. Schwimmer is represented by Donald Yarbrough of Donald A. Yarbrough ESQ in Fort Lauderdale.
