Man claims he is not responsible for alleged debt owed by late spouse

TAMPA – A Pasco County man claims a creditor continues to contact him regarding a debt allegedly owed by his late wife.

Ragan Rowland filed a complaint on Aug. 8 in the Tampa Division for the Middle District of Florida against Citibank N.A. alleging violation of the Florida Consumer Collection Practices Act and Telephone Consumer Protection Act.

According to the complaint, the defendant has been calling the plaintiff in an attempt to collect a debt allegedly owed by his deceased wife. The plaintiff alleges that he advised the defendant that he was not responsible for the account and revoked any prior express consent to contact him and directed defendant to contact his attorney instead. The suit states the defendant continued to make numerous calls to plaintiff’s cellular telephone and along with the use of an automatic telephone dialing system.

The plaintiff holds Citibank N.A. responsible because the defendant allegedly continued to place calls to plaintiff despite knowing that plaintiff was represented by an attorney and also violated TCPA by using an automatic telephone dialing system or an artificial or pre-recorded voice.

The plaintiff requests a trial by jury and seeks judgment against defendant, statutory damages, injunctive relief, costs of suit and other relief the court deems just. He is represented by Christopher W. Boss of Boss Law in St. Petersburg.
