Former employee files claim against East Ridge Retirement Village for alleged unpaid overtime

WEST PALM BEACH— A former employee has filed a class-action lawsuit against East Ridge Retirement Village Inc. and Jeffrey Merritt for alleged unpaid wages.

Rodolfo Silva filed a complaint on behalf of all others similarly situated on Aug. 12 in U.S. District Court for the Southern District of Florida against the defendants, alleging that they failed to fairly compensate the plaintiff for all of the hours he worked.

According to the complaint, the plaintiff alleges that between July 2015 and 2016, he worked for more than 40 hours without being paid any overtime wages. The plaintiff holds East Ridge Retirement Village Inc. and Jeffrey Merritt responsible because the defendants allegedly failed to pay the plaintiff any overtime premium for the hours he worked that exceeded the 40-hour work week.

The plaintiff seeks double damages, all overtime wages still owing, all legal fees and interest and any other relief as the court deems appropriate. He is represented by J.H. Zidell of J.H. Zidell P.A. in Miami Beach.
