Minnesota debt collector alleged to have violated debt law

Law money 02

MIAMI – A Pembroke Pines resident claims a debt collector did not report an alleged debt as disputed on his credit report.

Wilner Marcelin filed a complaint on Aug. 8 in the U.S. District Court for the Southern District of Florida against Diversified Adjustment Service Inc. alleging violation of the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Dec. 8, 2015, he disputed an alleged debt directly with the defendant by letter. The plaintiff holds Diversified Adjustment Service, Inc. responsible because the defendant allegedly did not remove the credit amount on plaintiff's credit report or tag it as "disputed by consumer."

The plaintiff seeks actual damages, statutory damages, all legal fees and any other relief as the court deems just. He is represented by Michael Jay Ringelheim of RC Law Group PLLC in Hackensack, New Jersey.
