Inmate files suit against correctional officer alleging his books were destroyed

BUSHNELL – A former inmate at a federal correctional institution in Coleman alleges his property was destroyed instead of being shipped to family.

Vincent J. Krocka filed a complaint on Aug. 5 in the Sumter County Circuit Court of Florida against Officer DeJesus, first name unknown, alleging trespass to chattel property and breach of oral contract.

According to the complaint, the plaintiff alleges that on Sept. 11, 2014, he learned of his pending transfer to a correctional facility in Atlanta and attempted to mail his collection of more than 100 nonfiction books to his family. The suit states he had difficulty in doing this and the defendant offered to do it. A few weeks after plaintiff's transfer, he alleges that discovered that his books were not mailed and instead destroyed due to prison policy.

The plaintiff requests a trial by jury and seeks judgment against the defendant in the amount of $1,927 as replacement cost of his books and costs of this action. He is representing himself.
