Couple files claim against Checker Yellow Cab of Jacksonville after car collision

JACKSONVILLE BEACH — A couple has filed a claim against a local cab company after the wife was involved in a car accident with one of the cabs.

Jennifer Bushnell and John Owens filed a complaint on Aug. 4 in the Fourth Judicial Circuit Court of Duval County against Checker Yellow Cab of Jacksonville LLC, Adam Ishag Yahia and USAA Casualty Insurance Company, cab operator, citing alleged loss of consortium, negligence, vicarious liability and that they failed to exercise reasonable care.

According to the complaint, the plaintiffs allege that, on Jan. 16, 2015, while Bushnell was driving along J. Turner Butler Boulevard, a cab driven by Yahia collided with her vehicle. As a result, the plaintiff suffered bodily injuries, permanent disfigurement, mental anguish, lost wages, medical expenses and aggravated a previously existing condition. Plaintiff John Owens, has suffered the loss of companionship and consortium of his wife.

The plaintiffs hold Checker Yellow Cab, Adam Ishag Yahia and USAA Casualty Insurance Company responsible because the defendants allegedly failed to operate a vehicle with reasonable care, failed to perform adequate background screening prior to hiring employees and non-payment of insurance coverage despite plaintiffs' compliance of terms and conditions.

The plaintiffs request a trial by jury and seek judgment against the defendants for damages in excess of $15,000, exclusive of interests, costs and attorneys' fees. The plaintiffs are represented by David H. Margol and Rodney S. Margol of Margol & Margol PA in Jacksonville Beach.
