Man claims ramp at Kangaroo Store caused fall, injuries

GAINESVILLE – An Alachua County man alleges a poorly maintained ramp caused him to fall.

Earl Maxwell filed a complaint on July 1 in the U.S. District Court for the Northern District of Florida, Gainesville Division against Marketmasters of the Southeast Inc., Louis L. Huntley Enterprises Inc., The Pantry Inc. and Circle K Stores Inc. alleging violations of the Americans with Disabilities Act.

According to the complaint, the plaintiff alleges that on May 2, 2014, while he was using a handicap access ramp at the entrance of Kangaroo Store, he was caused to fall because of the ramp's poor condition. He alleges the incident caused him to sustain injury to his left hip that required immediate hip replacement surgery.

The plaintiff holds Marketmasters of the Southeast Inc., Louis L. Huntley Enterprises Inc., The Pantry Inc., and Circle K Stores Inc. responsible because they allegedly failed to provide alterations and failed to warn the public and business invitees of the dangers associated with the ramp.

The plaintiff requests a trial by jury and seeks compensatory damages, attorney's fees, costs and litigation expenses and any other such relief as the court deems just and proper. He is represented by Paul S. Rothstein in Gainesville.
