Woman alleges National Auto Division violated TCPA, called to sell warranties

ORLANDO – An Orange County woman alleges a New Jersey company contacted her using an automatic dialing system to solicit its services.

Judi Brown filed a complaint on July 25 in the U.S. District Court for the Middle District of Florida against National Auto Division LLC alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in January, the defendant contacted her about procuring a vehicle service warranty through it. The plaintiff holds National Auto Division LLC responsible because the defendant allegedly contacted plaintiff using an automatic dialing system and that despite her requests to stop contacting her, the calls continued. The suit states the plaintiff had no prior relationship with the defendant.

The plaintiff requests a trial by jury and seeks damages, permanent injunction, and any other relief as this court deems just. She is represented by Marc A. Wites of Wites & Kapetan PA in Lighthouse Point.
