Man alleges Miami-Dade County car wash did not pay minimum wage

MIAMI – A car washer has filed a class-action suit against his former employer alleging he was not paid overtime or a proper minimum wage while employed.

Dione Francis filed a complaint on behalf of other similarly situated individuals on July 25 in the U.S. District Court for the Southern District of Florida, Miami Division against Aventura Finest Carwash and Service at the Mall Inc., doing business as Aventura Finest Carwash and Service at the Mall Inc. 2; Guillermo Freile; and Emilio G. Lourdes alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that he was employed by the defendants from from April 2014 to May and worked without being paid at the legal minimum wage as well as overtime premiums for hours worked in excess of 40 per week. The plaintiff holds Aventura Finest Carwash and Service at the Mall Inc., doing business as Aventura Finest Carwash and Service at the Mall Inc. 2; Guillermo Freile; and Emilio G. Lourdes responsible because the defendants allegedly violated the FLSA as well as illegally charged a weekly uniform lease fee.

The plaintiff requests a trial by jury and seeks $62,598.60 in unpaid wages, double damages/liquidated damages, all legal fees and any other relief as the court deems just. He is represented by R. Martin Saenz of Saenz & Anderson PLLC in Aventura.
