Law firm claims Texas company sent unsolicited faxes

MIAMI – A Miami law firm alleges a Texas construction company sent unsolicited faxes advertising it services.

The Law Offices of Timothy Carl Blake PA filed a complaint on behalf of all others similarly situated on July 25 in the U.S. District Court for the Southern District of Florida, Miami Division against Tri State Roofing and General Contractors LLC alleging violation of the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that on March 7, it received an unsolicited advertisement through its telephone facsimile from the defendant. The plaintiff holds Tri State Roofing and General Contractors LLC responsible because the defendant allegedly sent a facsimile advertisement to plaintiff without containing an opt-out notice as required by law.

The plaintiff requests a trial by jury and seeks statutory damages, interest, all legal fees and any other relief as the court deems just. It is represented by Shawn A. Heller and Joshua A.
